Can I transfer customer data out of Hong Kong

Transferring customer data out of Hong Kong is allowed under the PDPO if you have the data subject's consent or meet other specified conditions.

Can I Transfer Customer Data Out of Hong Kong

You can transfer customer data out of Hong Kong, but the Personal Data (Privacy) Ordinance (Cap. 486) imposes conditions you must satisfy first. The PDPO does not prohibit cross-border data flows outright. It requires you to ensure personal data transferred outside Hong Kong is protected to a standard no less than that required under the Ordinance.

PDPO Data Transfer Overseas

The PDPO's data protection principles form the legal framework for any overseas transfer. Principle 4 (security of personal data) requires you to take all reasonably practicable steps to protect personal data against unauthorised or accidental access, processing, erasure, loss or use. When data is transferred outside Hong Kong, you remain responsible for that protection. The Privacy Commissioner for Personal Data has issued guidance stating you must take contractual, technical or organisational measures to maintain an equivalent level of protection.

Hong Kong Data Export Rules

The primary pathway for a lawful transfer is to obtain the data subject's voluntary and express consent. Before giving consent, the data subject must be informed of the transfer's purpose and the categories of persons to whom the data may be transferred. Consent obtained through a blanket clause in a privacy policy, without specific disclosure, is unlikely to satisfy the PDPO's requirements.

Where consent is not practicable, you may rely on a contractual arrangement with the recipient outside Hong Kong. The contract should include provisions requiring the recipient to comply with data protection standards equivalent to those under the PDPO. The Privacy Commissioner has published model clauses you may adopt. If you transfer data under such a contract, you must still be able to demonstrate the recipient has adequate security measures in place.

Cross-Border Data Transfers Hong Kong

You must also comply with Principle 3 (use of personal data) when transferring personal data outside Hong Kong. Personal data may be used only for the purpose for which it was collected, or a directly related purpose, unless the data subject has given prescribed consent. A transfer to a third party for a new purpose, such as data processing by a cloud service provider, requires fresh consent or a contractual arrangement that restricts the recipient's use to the original purpose.

The PDPO does not currently require you to register a transfer with the Privacy Commissioner or conduct a formal transfer impact assessment. However, the Privacy Commissioner may investigate a complaint or conduct an inspection. If you cannot demonstrate compliance, you risk enforcement action, including a written warning or a direction to remedy the contravention.

Practical Steps for Compliance

Before transferring customer data outside Hong Kong, you should:

  • Identify the categories of personal data to be transferred and the purpose of the transfer.
  • Assess whether the recipient in the destination jurisdiction has data protection measures comparable to those under the PDPO.
  • Obtain the data subject's informed consent, or enter into a contract with the recipient that imposes equivalent data protection obligations.
  • Document the basis for the transfer, including the consent record or the contractual terms, and retain that documentation for inspection.

The PDPO does not prescribe a specific form for the consent or the contract. Following the Privacy Commissioner's guidance and maintaining a clear audit trail of your compliance decisions puts you in a defensible position.
