Every employee under a continuous contract gets one rest day in every 7-day period. The Employment Ordinance (Cap. 57) sets this rule, which applies the moment the 4-18 test is met: four weeks with the same employer, at least 18 hours in each week. The employer chooses the day. An employee cannot be compelled to work on it. If the employee agrees to work, the employer must pay extra.

Hong Kong Rest Day Rules

An employee under a continuous contract is entitled to not less than one rest day in each period of 7 days. The Employment Ordinance (Cap. 57) defines a rest day as a continuous period of not less than 24 hours during which the employee is not required to work for the employer.

The employer determines the rest day. Whether fixed each week or rotating, the employer must notify the employee of the schedule. An employer who fails to grant a rest day commits an offence and may be liable to a fine.

Hong Kong Employment Ordinance Rest Days

Part IV, sections 17 to 22 of the Employment Ordinance (Cap. 57) governs rest days. The ordinance applies to all employees engaged under a contract of employment, with limited exceptions. Close relatives of the employer and persons employed outside Hong Kong fall outside its scope. The Labour Department publishes guidance on rest day entitlements. The ordinance draws a firm line between rest days, statutory holidays and annual leave. A rest day is a weekly entitlement, not a holiday. Statutory holidays are 12 specified days per year under the Employment Ordinance. Annual leave is paid leave accrued after 12 months of continuous employment. These three are separate entitlements. An employer cannot count a rest day as a statutory holiday or annual leave day.

Hong Kong Statutory Rest Day Entitlement

The statutory rest day entitlement applies to every employee under a continuous contract. There is no minimum length of service beyond the 4-18 rule. Once the employee qualifies, the entitlement begins immediately.

The employer must grant the rest day within the 7-day period. Employer and employee may agree to postpone the rest day to a later date, but the postponement must fall within the same month. The employer must notify the employee of the new rest day at least 48 hours in advance. If the rest day falls on a statutory holiday, the employer must grant another rest day on a different day.

Hong Kong Rest Day Timing Requirements

The employer sets the timing, subject to one requirement: a continuous 24-hour period within each 7-day period. The rest day may fall on Sunday, Saturday, or any weekday. A rotating schedule is permitted, provided each 7-day period contains one rest day.

If the employee works on a rest day voluntarily, the employer must pay the employee at the normal wage rate for the hours worked and grant a substitute rest day within 30 days of the original rest day. The substitute rest day must be a continuous 24-hour period. The employer cannot compel the employee to work on a rest day. Any agreement to work must be voluntary.

Compulsory Rest Day and Voluntary Work on Rest Day

The Employment Ordinance prohibits compulsory work on a rest day. An employer who requires an employee to work on a rest day without voluntary agreement commits an offence. The employee may refuse without penalty.

Where the employee agrees to work, the employer must pay at the normal wage rate for the hours worked and grant a substitute rest day within 30 days. The substitute rest day must be a continuous 24-hour period. The employer may not deduct wages or reduce other entitlements because the employee worked on a rest day.

Limited exceptions exist. In certain industries and circumstances , machinery breakdown, urgent work, or unforeseen events , an employer may require an employee to work on a rest day without agreement. The employer must notify the Labour Department within 48 hours of doing so.

Rest Day Pay and Other Entitlements

A rest day is unpaid unless the employee works on it. No work, no wages for that day. If the employee works, the employer pays at the normal wage rate for the hours worked.

Rest days do not diminish other entitlements. Sickness allowance under the Employment Ordinance is calculated based on normal wages, and rest days count as days of employment for calculating continuous service. Employees' compensation insurance under the Employees' Compensation Ordinance (Cap. 282) covers injuries sustained on a rest day if the employee is at work. End-of-year payment and MPF contributions are calculated on relevant income, which includes wages paid for work on rest days.

Distinction From Statutory Holidays

Rest days are separate from statutory holidays. Statutory holidays are 12 specified days per year under the Employment Ordinance , Lunar New Year's Day, Labour Day, and others. They are paid holidays for employees under a continuous contract. Rest days are weekly unpaid days off.

If a rest day falls on a statutory holiday, the employer must grant another rest day on a different day. The employer may not count the statutory holiday as the rest day. The statutory holiday must also be granted separately as a paid holiday.

Practical Compliance for Employers

Keep records. Maintain records of rest days granted and any work performed on rest days. The Labour Department may inspect those records during an investigation. Communicate rest day schedules to employees clearly and in writing.

Employers who fail to grant rest days or who compel employees to work on rest days face prosecution and fines. The Labour Department can issue warnings, require compliance, or take legal action. Seek professional advice if obligations under the Employment Ordinance are unclear.
