File Form BIRS8 with your corporation's Profits Tax Return (BIR51) to claim the tax concession for a qualifying corporate treasury centre. The Inland Revenue Department (IRD) uses this form to verify your company meets the statutory conditions under section 14A of the Inland Revenue Ordinance (Cap. 112) and to compute the reduced profits tax rate on qualifying treasury transactions. This is not a standalone return. It accompanies your annual profits tax filing and must be submitted through the Business Tax Portal or the Tax Representative Portal if your company is subject to mandatory electronic filing.

Eligibility Conditions for a Qualifying Corporate Treasury Centre

Your corporation qualifies as a qualifying corporate treasury centre if it meets the conditions in section 14A of Cap. 112. The company must carry on a business in Hong Kong and derive profits from qualifying treasury transactions. These transactions include providing treasury services to associated corporations, such as cash pooling and foreign exchange hedging, as well as raising finance and managing interest rate risk. The corporation cannot be a financial institution as defined in the ordinance. At least 75% of its total assets must be attributable to treasury activities. You must also elect in writing to be treated as a qualifying corporate treasury centre for the year of assessment. Make this election on Form BIRS8 itself. Once made, it applies to all subsequent years unless revoked.

BIRS8 Form Treasury Centre Filing Requirements

Complete and submit the BIRS8 form with the Profits Tax Return (BIR51) for the relevant year of assessment. It requires the corporation's name, business registration number, and tax file number. The form also asks for the date of the election to be treated as a qualifying corporate treasury centre and the year of assessment to which the election applies. You must confirm the company meets the 75% asset test and is not a financial institution. A breakdown of income from qualifying treasury transactions and non-qualifying transactions, along with corresponding expenses, is also required. The IRD uses this breakdown to compute the profits tax concession, which reduces the standard 16.5% rate to 8.25% on profits from qualifying treasury transactions.

Hong Kong Corporate Treasury Centre Tax Concession Details

The Hong Kong corporate treasury centre tax concession halves the profits tax rate on qualifying treasury transactions, from 16.5% to 8.25%. To claim it, file Form BIRS8 and attach a tax computation that shows profits from qualifying treasury transactions separately from other profits. You must also attach a certified true copy of your financial statements, prepared in accordance with Hong Kong Financial Reporting Standards or equivalent. These statements must clearly identify the treasury activities and the associated assets and liabilities. The IRD may request additional information to verify the 75% asset test, including a schedule of the corporation's assets and a breakdown of the treasury activities.

Qualifying Corporate Treasury Centre Form Completion Guide

The qualifying corporate treasury centre form is divided into several parts. Part A requires the corporation's particulars: name, address, and tax file number. Part B asks for the election details, including the date of election and the year of assessment. Part C requires the corporation to confirm it meets the conditions for the concession, including the 75% asset test and non-financial institution status. Part D requires a detailed breakdown of income and expenses from qualifying and non-qualifying transactions. A reconciliation of the profits from qualifying treasury transactions to the profits shown in the financial statements is also necessary. Part E is for the declaration and signature of the director or company secretary. The form must be signed by a director or the company secretary. For electronic filing, the digital signature of the authorised person is accepted.

Inland Revenue BIRS8 Electronic Filing and IXBRL Requirements

The Inland Revenue BIRS8 form is available for electronic filing through the Business Tax Portal and the Tax Representative Portal. From 1 April 2026, corporations that are in-scope multinational enterprise groups must file their profits tax returns and supplementary forms electronically. Electronic filers must tag the financial statements and tax computation in iXBRL format. This tagging applies to the financial statements that accompany the BIR51 and the supplementary forms, including Form BIRS8. The IRD provides a taxonomy and tagging guide on its website. The corporation must ensure the iXBRL tags correctly identify the qualifying treasury transactions and the associated profits. The IRD may reject the filing if the tagging is incomplete or incorrect. Paper filing remains available for corporations not subject to mandatory electronic filing, but the IRD has stated an intention to reach full electronic filing by 2030.

Supporting Documents Required with Form BIRS8

When filing Form BIRS8, attach a certified true copy of the corporation's financial statements for the relevant year of assessment. These must include a profit and loss account, a balance sheet, and notes that disclose the treasury activities. A tax computation showing the profits from qualifying treasury transactions and the computation of the tax concession is also required. This computation must be prepared in accordance with the IRD's guidelines. Provide a schedule of the corporation's assets to demonstrate that at least 75% of its total assets are attributable to treasury activities. This schedule must list each asset and its value, and identify which assets are used for treasury activities. The IRD may request additional supporting documents, such as contracts, invoices, and bank statements, to verify the treasury transactions.

Consequences of Incorrect or Late Filing

Filing Form BIRS8 with incorrect or incomplete information may result in the IRD rejecting the election for the tax concession. The corporation may then be assessed at the standard profits tax rate of 16.5% on all its profits. If the corporation files the form late, the IRD may impose a penalty under section 80 of Cap. 112. This penalty can be up to three times the amount of tax undercharged. Ensure the form is completed accurately and submitted on time. The due date for filing the Profits Tax Return and the supplementary forms is generally within one month of the date of the tax return, unless an extension has been granted. Check the IRD's website for the current filing deadlines and any extensions that may apply.

Part 1 - Applicant’s Details

1. Name of applicant
Enter the full legal name of the corporation applying for qualifying corporate treasury centre (QCTC) status. This must match the name on the Certificate of Incorporation.

2. Business Registration No.
Enter the 8-digit business registration number. This is printed on the Business Registration Certificate issued by the Inland Revenue Department.

3. Company No.
Enter the company registration number as shown on the Certificate of Incorporation issued by the Companies Registry.

4. Address of registered office
Give the registered office address exactly as recorded with the Companies Registry. If the corporation has changed its address, update the Companies Registry first.

5. Address of principal place of business in Hong Kong (if different from 4)
Only complete this box if the main business operations are at a different location from the registered office. Leave blank if the same.

6. Date of incorporation in Hong Kong
Enter the date shown on the Certificate of Incorporation. This must be in the format DD/MM/YYYY.

7. Financial year end date
Enter the last day of the corporation’s accounting period, e.g., 31/12/YYYY. This date must match the one used for profits tax returns.

12. Signature
The person named in box 10 must sign here. Electronic signatures are not accepted unless the IRD has confirmed otherwise.

13. Date
Enter the date of signing in DD/MM/YYYY format. This date must be on or after the date the corporation meets the conditions.

Common mistakes: - Box 6: The date of incorporation must match the Certificate of Incorporation exactly. Do not use the date of business registration. - Box 8: Only one year of assessment per form. Do not tick multiple boxes. - Box 9: The 75% profit condition is calculated on a three-year average or the period since incorporation if shorter. Incorrect self-assessment is a common error. - Box 10: The signatory must be listed on the Companies Registry’s register of directors or company secretaries. A tax representative cannot sign unless also a director or secretary. - Continuation sheets: If additional space is needed for any part, attach a separate sheet headed with the applicant’s name and the form reference BIRS8.
