What is Know Your Customer (KYC) in Hong Kong?

Know Your Customer (KYC) is the process of identifying and verifying clients to prevent money laundering, required under Hong Kong's AMLO.

Know Your Customer (KYC) Compliance in Hong Kong

Know Your Customer (KYC) is how a regulated entity verifies client identity to prevent financial crime, including money laundering and terrorist financing. In Hong Kong, KYC is a core component of customer due diligence under the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (Cap. 615, "AMLO"). A financial institution must identify each client, establish any corporate structure's beneficial owner, and understand the source of funds for the business relationship. The phrase "know your customer hong kong" describes the specific application of these rules under Hong Kong's regulatory framework.

KYC Compliance Hong Kong

Banks, securities firms, and licensed trust or company service providers (TCSPs) must all comply with KYC. The AMLO sets out the minimum steps: identify and verify the client's identity, identify the beneficial owner, and understand the purpose and intended nature of the business relationship. A regulated entity must also conduct ongoing monitoring of transactions to ensure they are consistent with the client's profile.

Customer Due Diligence Hong Kong

Customer due diligence is the broader framework that includes KYC. Under the AMLO, a regulated entity must perform customer due diligence before establishing a business relationship. It is also required when the entity suspects money laundering or terrorist financing, or when it doubts the veracity of previously obtained identification data. The due diligence process covers identification, verification, risk assessment, and ongoing monitoring.

AMLO KYC Requirements

The AMLO KYC requirements are set out in Schedule 2 of the Anti-Money Laundering and Counter-Terrorist Financing Ordinance. They require a regulated entity to obtain the client's name, date of birth, nationality, and residential address for an individual. For a company, the required information is the name, place of incorporation, and registered office. The entity must verify this information using reliable, independent source documents. For a corporate client, the entity must identify the beneficial owner and take reasonable measures to verify their identity.

KYC for Banks Hong Kong

KYC for banks follows the same AMLO framework but is supplemented by guidance from the Hong Kong Monetary Authority (HKMA). Banks must apply enhanced due diligence for higher-risk clients, such as politically exposed persons (PEPs) and clients from jurisdictions with weak AML controls. The HKMA expects banks to maintain a risk-based approach. Transaction monitoring systems must detect unusual activity, and a record-keeping regime must preserve identification and transaction data for at least seven years.
