How to claim offshore profits exemption in Hong Kong

An offshore claim in Hong Kong is an application to the IRD to exempt profits sourced outside Hong Kong from tax.

Offshore Claim Hong Kong

An offshore claim in Hong Kong is an application to the Inland Revenue Department (IRD) to treat profits as exempt from profits tax under the territorial source principle. This principle taxes only profits arising in or derived from Hong Kong. An offshore claim hong kong asserts that the assessable profits in question were generated entirely outside Hong Kong and therefore fall outside the charge to tax.

Hong Kong Offshore Profits Exemption

The exemption is not automatic. You must demonstrate that the profits were sourced offshore, meaning the business activities giving rise to the profits took place outside Hong Kong. The IRD applies the "operations test" set out in Departmental Interpretation and Practice Note 21 (DIPN 21) to determine the locality of profits. The place where the contracts are made, where the goods are sourced, and where the services are performed are all relevant factors.

Claiming Offshore Profits Hong Kong

Make the claim by completing the relevant section of the profits tax return (Form BIR51 for corporations). Provide a detailed explanation of the business activities and the place of operation. You must also submit supporting documents, including contracts, invoices, correspondence, and evidence of the physical location of staff and decision-making. The IRD expects a clear audit trail showing that no key profit-generating activities occurred in Hong Kong.

Inland Revenue Offshore Claim

The IRD scrutinises offshore claims closely. A claim may trigger a tax investigation, during which the department may request further evidence and interview the taxpayer or its representatives. If the IRD rejects the claim, you may lodge an objection and, if necessary, an appeal to the Commissioner of Inland Revenue. The burden of proof rests on the taxpayer to establish the offshore status of the profits.

Hong Kong Tax Offshore Status

Obtaining offshore status requires more than a passive holding of funds or a simple contractual arrangement. The IRD examines the substance of the business. A company that merely invoices from Hong Kong but performs all operations elsewhere may still fail the test if the key decisions or core functions are managed from Hong Kong. Professional advice is strongly recommended before making an offshore claim.
