SIS-4A Fit and Proper Criteria for Money Lender Renewal

The SIS-4A form is the supplementary information statement for individual applicants and partnerships renewing a money lender licence under the Money Lenders Ordinance (Cap. 163). It sets out the Commissioner of Police's assessments of character, competence and financial standing when evaluating a renewal application.

Money Lender Licence Renewal Hong Kong

A Hong Kong money lender licence is valid for 12 months. You must renew it before it expires. Submit Form 8 with the SIS-4A supplementary information statement. The Commissioner of Police will not process a renewal unless you demonstrate you continue to satisfy the fit and proper criteria throughout the licence period. File the renewal application at least 28 days before the licence expires. The Commissioner may accept late applications in exceptional circumstances.

Fit and Proper Test SIS-4A

The SIS-4A fit and proper test examines character, competence and financial standing. The Commissioner of Police assesses whether the individual or each partner in a partnership remains suitable to hold a money lender licence. This is not a one-time check. The licensing authority expects you to maintain the required standards continuously. Disclose any material change in circumstances between renewals in the SIS-4A declaration form.

Hong Kong Money Lenders Ordinance

The Money Lenders Ordinance (Cap. 163) provides the legal framework for money lending in Hong Kong. Section 7 of the Ordinance empowers the Commissioner of Police to grant, refuse or revoke licences. The fit and proper criteria derive from the Ordinance and the licensing authority's published guidelines. The Commissioner considers whether you have been convicted of any offence involving dishonesty, fraud or moral turpitude, and whether your financial standing is sound enough to operate a money lending business without risk to borrowers.

Individual Partnership Money Lender Renewal

An individual applicant must declare their full name, Hong Kong identity card number, residential address and business address on the SIS-4A. For a partnership renewal, each partner must complete a separate SIS-4A. The licensing authority treats each partner as an individual applicant for fit and proper purposes. If any partner fails the fit and proper test, the partnership as a whole may be refused renewal. The declaration form must be signed by the individual or by each partner personally; a corporate representative cannot sign on behalf of a partner.

Character Assessment and Criminal Record Check

Character assessment carries the most weight in the SIS-4A fit and proper criteria. You must declare whether you have been convicted of any criminal offence in Hong Kong or elsewhere, including offences that are spent or subject to appeal. The Commissioner of Police conducts a criminal record check through the Hong Kong Police Force. Convictions for theft, fraud, bribery, drug trafficking or any offence under the Money Lenders Ordinance are likely to result in refusal. You must also disclose any pending criminal proceedings or investigations.

Financial Standing and Business Experience

The financial standing assessment requires evidence of sufficient capital and liquidity to operate the money lending business. The SIS-4A asks for details of your assets, liabilities and income sources. The licensing authority expects your net worth to be proportionate to the scale of lending proposed. Business experience in money lending or a related financial service is considered favourably, though it is not a mandatory requirement. The Commissioner may request bank statements, audited accounts or tax returns to verify the financial information provided.

Supporting Documents for SIS-4A

Supporting documents must accompany the SIS-4A to substantiate your declarations. These typically include a copy of your Hong Kong identity card, a recent photograph, a business registration certificate from the Inland Revenue Department, and proof of the business address. If you have changed address or business name since the last renewal, the supporting documents must reflect the current details. The Commissioner may request additional documents if the information provided is incomplete or raises concerns.

Approval Process and Compliance Requirements

The Licensing Office of the Hong Kong Police Force reviews a renewal application submitted with SIS-4A. The Commissioner may grant the renewal, impose conditions on the licence, or refuse the application. If the Commissioner intends to refuse, you are given an opportunity to make representations before a final decision is made. Compliance requirements continue throughout the licence period. You must notify the Commissioner of any change in circumstances that could affect your fit and proper status, such as a criminal conviction or bankruptcy.

Regulatory Authority and Declaration Form

The Commissioner of Police is the regulatory authority for money lender licensing, delegating day-to-day administration to the Licensing Office. The SIS-4A declaration form requires you to confirm the information provided is true and complete. Making a false declaration is an offence under the Money Lenders Ordinance and may result in prosecution or revocation of the licence. Retain a copy of the completed SIS-4A and supporting documents for your records; the Commissioner may refer to them in future renewal applications.
