How far back can the IRD assess me

The IRD can generally assess you for six years, extending to seven for negligence, with no limit for fraud.

How Far Back Can the IRD Assess Me

The Inland Revenue Department can generally assess you for a period of six years from the end of the year of assessment, but this extends to seven years in cases of negligence and there is no time limit if there is fraud or willful evasion. How far back the IRD can assess you depends entirely on the circumstances of each case and the conduct of the taxpayer.

Hong Kong Tax Assessment Time Limit

The standard time limit for the IRD to issue a notice of assessment is six years after the end of the relevant year of assessment. For the year of assessment 2020-21 (ending 31 March 2021), the IRD must generally raise an assessment by 31 March 2027. This six-year period applies where the taxpayer has filed a tax return and the IRD has no reason to believe there was any understatement or omission. The basis period for each year of assessment is the accounting period that ends in that year, and the time limit runs from the end of the assessment year, not from the filing date of the return.

IRD Back Assessment Period

The IRD back assessment period extends to seven years where the IRD considers that a taxpayer has been negligent. Negligence means failing to take reasonable care in preparing the tax return or failing to disclose all relevant information. In such cases, the IRD may issue an assessment up to seven years after the end of the year of assessment. This extended period gives the department additional time to investigate cases where the taxpayer should have known better but did not act with sufficient care.

Statute of Limitations Tax HK

The statute of limitations tax HK framework has a critical exception: there is no time limit where the IRD can prove fraud or willful evasion. Fraud includes deliberate concealment of income or falsification of records. Willful evasion means intentionally avoiding tax liability through actions such as omitting income, claiming false deductions, or destroying accounting records. In these cases, the IRD can assess tax for any year, no matter how far back, and can also prosecute the taxpayer under the Inland Revenue Ordinance.

How Long Can IRD Investigate

The IRD can investigate for as long as the assessment time limit allows. During an investigation, the department may request accounting records, bank statements, contracts, and other supporting documents. The IRD expects taxpayers to keep all accounting records for at least seven years after the transaction, which aligns with the extended assessment period for negligence. If the IRD suspects fraud, it may investigate years beyond the seven-year period and may also refer the case for criminal prosecution.

What to Do If You Receive a Backdated Assessment

If you receive a notice of assessment for a year outside the normal six-year period, first check whether the IRD has cited negligence or fraud as the reason. You have the right to object to the assessment by filing a written notice of objection within one month of the assessment date. The objection should explain why the assessment is incorrect or why the time limit has expired. If the IRD has not provided evidence of negligence or fraud, the assessment may be invalid. However, if the IRD has evidence of willful evasion, the assessment can stand and the department may also pursue penalties and prosecution.

Practical Steps for Compliance

Protect against back assessments by maintaining complete accounting records for at least seven years after each transaction. File your tax return accurately and on time. If you discover an error in a previous return, notify the IRD voluntarily before the department discovers it, as voluntary disclosure may reduce penalties. If the IRD opens an investigation, cooperate fully and provide all requested documents promptly. Engaging a tax representative who understands the assessment time limits and the IRD's investigation powers can help you navigate the process and protect your rights.
