Form BIR56A: Hong Kong employer's return explained

Form BIR56A is the annual return filed by Hong Kong employers to report employee remuneration and pensions to the Inland Revenue Department.

What Is Form BIR56A Employer's Return

Form BIR56A is the annual return every Hong Kong employer files with the Inland Revenue Department. It reports all remuneration and pensions paid to employees during the preceding year of assessment. Titled "Employer's Return of Remuneration and Pensions", the form is the IRD's primary tool for collecting information to administer salaries tax.

The return captures all employee payments. Include salaries, wages, bonuses, commissions, allowances, tips, and any other benefits-in-kind. It also covers pension payments made to former employees or their dependants. File a nil return if the employer had no employees during the year.

Form BIR56A Hong Kong

The IRD issues Form BIR56A annually to every employer who has filed before. New employers receive the form after notifying the IRD of their first employee. It is sent in early April each year, covering the year of assessment that ended on 31 March.

Employers must submit the completed return with an individual Form IR56B for every person employed during the year, whether they were paid or not. Form IR56B is the individual employee's return of remuneration. Retain a copy of each IR56B for your records.

Employer's Return of Remuneration and Pensions

Form BIR56A requires a list of every person employed at any time during the year. This includes directors, part-time workers, and casual staff. For each employee, provide their full name and Hong Kong Identity Card number, period of employment, total remuneration paid (including salaries, bonuses, commissions, and allowances), the amount of MPF contributions made by the employer, and any pensions paid to former employees.

A director, company secretary, or other authorised person must sign the return. For sole proprietorships or partnerships, the proprietor or a partner must sign.

IRD Form BIR56A

The IRD issues Form BIR56A as part of its annual employer filing cycle, accompanied by instructions and a return envelope. The department cross-checks the return's information against individual tax returns filed by employees on Form BIR60 to ensure all income is declared and taxed correctly.

If you do not receive the form by mid-April, contact the IRD for a duplicate. The IRD automatically issues the form each year to all employers on record. Even if you have ceased business or have no employees, you must still file the return and indicate that no one was employed.

BIR56A Due Date

The filing deadline is generally one month from the date of issue, typically the first working day of May. Employers with a tax representative may qualify for the IRD's block extension scheme. This extends the deadline to 1 June for employers with a year of assessment ending 31 March, 15 June for those ending 30 April, 15 July for those ending 31 May, and 15 August for those ending 30 June.

Employers who do not qualify for the block extension must file by the original due date stated on the form. Late filing can result in penalties, including a fine of up to HK$10,000 and a further penalty of three times the amount of tax undercharged.

Hong Kong Employer Tax Filing

Filing Form BIR56A is a core component of employer tax compliance. Employers must also file other forms throughout the year. File Form IR56E to notify the IRD of a new employee within three months of their commencement. File Form IR56F at least one month before an employee ceases employment. File Form IR56G at least one month before an employee departs Hong Kong.

These forms keep the IRD's workforce information current for correct salaries tax assessment. Failure to file them can result in penalties.

How to File Form BIR56A

File Form BIR56A electronically through the IRD's Business Tax Portal or by paper. Electronic filing is faster and reduces errors. The IRD's data submission facility lets employers upload a file of employee data in a specified format, avoiding the need to complete each IR56B individually.

To file electronically, register for the Business Tax Portal to obtain a user ID and password. The portal allows online completion, data upload, and submission with a digital signature. Paper filing is accepted, but the form and all supporting documents must reach the IRD by the due date.

What to Do After Filing

Retain a copy of the return and all supporting documents for at least seven years. The IRD may request more information; respond promptly. If an error is found after filing, notify the IRD immediately and submit a corrected return.

For questions about the form or process, contact the IRD's Employer Services hotline or a tax professional. The IRD website provides detailed guidance, including a completion guide and frequently asked questions.
