What Is the IRD Property Letting Notification Requirement

The ird property letting notification is a statutory duty under the Inland Revenue Ordinance (Cap. 112). A landlord letting a Hong Kong property must notify the IRD within a specified period. This notification triggers the IRD's assessment of property tax on the rental income. The department relies on these filings to maintain accurate records of taxable rental income, and failure to notify can lead to penalties.

The form requires details of the property, the tenancy particulars, and the identities of the parties. The IRD uses this to verify landlords declare rental income correctly in their tax returns. Owners of multiple properties must file a separate Form IR6129 for each letting.

How to Complete Form IR6129 Hong Kong

When to Notify IRD of Rental Income

The obligation to notify ird of rental income is time-sensitive. Form IR6129 must be submitted within 7 days after the tenancy commencement date. This is the date the tenant first gains the right to occupy the property, not the date the tenancy agreement is signed.

Missing the 7-day window may result in a penalty. The penalty is calculated on the tax that would have been assessed had the notification been on time. If a landlord misses the deadline, submit the form immediately with an explanation of the delay. The IRD may exercise discretion in penalty assessment.

The 7-day deadline applies to all new lettings, including renewals with changed terms and sub-lettings where the head landlord is not the sub-landlord.

Hong Kong Property Tax Notification for New Lettings

The letting of properties form (IR6129) is available on the IRD website. Submit it by post or in person to the Property Tax Unit. There is no electronic filing option.

Pay close attention to these fields:

Monthly rent: Enter the amount in Hong Kong dollars. If rent is paid in a foreign currency, convert it to Hong Kong dollars at the exchange rate on the commencement date.

Rent-free period or concession: Disclose any rent-free period, reduced rent period, or other concession in the remarks section. The IRD uses this to calculate the effective annual rent for property tax.

Deposit and premium: Report any key money, premium, or non-refundable deposit paid by the tenant. These are treated as rental income in the year received.

Management fee and rates: If the landlord pays the management fee or government rates for the tenant, these amounts are part of the gross rent for property tax. State whether the rent is inclusive or exclusive of these charges.

The landlord must sign and date the form. If a tax representative completes it, they must provide their name, contact details, and Tax Representative Number.

Obligation to Notify and Penalties for Non-Compliance

The obligation to notify the IRD of a property letting is a statutory duty under the Inland Revenue Ordinance. Failure to submit Form IR6129 within the 7-day period may incur a penalty of up to 10% of the tax undercharged due to the late notification. Wilful evasion can attract a higher penalty.

The IRD may also raise an estimated assessment based on available information. This assessment is typically higher than the actual tax liability, as the IRD applies a conservative approach. The landlord must then object and provide the correct information, a more burdensome process than filing on time.

Landlords with rental income who have not received a property tax return must still submit Form IR6129. The IRD will issue the appropriate tax return after receiving the notification. Waiting for the return is not a valid excuse for late submission.

Practical Tips for Landlords

Keep a copy of the completed Form IR6129. The IRD may request supporting documents, such as the tenancy agreement, to verify the information. Retain these documents for at least 7 years after the end of the year of assessment.

A property management agent may assist with the form, but the legal obligation to notify remains with the landlord. Confirm the agent has submitted the form and obtain a copy of the IRD's acknowledged receipt.

The notification requirement applies to short-term lettings, such as serviced apartments or holiday homes. Report each arrangement separately, even if the same tenant renews for consecutive short periods.

1. Your Personal Details

"我的全名是" / "I (Surname First)" Enter your full name. The form asks for your surname first, for example "CHAN Tai Man". Use the same name as you use on your tax return.

"香港身分證號碼/護照號碼*" / "Hong Kong Identity Card No. / Passport No." Provide your Hong Kong ID number. If you do not have one, provide your passport number. Delete the inapplicable option (cross out "Passport No." or "Hong Kong Identity Card No.").

"(先生/女士/小姐)" / "(Mr / Mrs / Ms / Miss)" Delete whichever does not apply.

2. Property Ownership and Address

"是以下物業的全權擁有/分權擁有/聯權擁有人" / "am the sole owner / co-owner / joint owner" Select one. Delete the two that do not apply. - Sole owner - you own the property alone. - Co-owner - you own a specific share of the property with others. - Joint owner - you own the whole property equally with others (survivorship rights).

Property address Write the full postal address of the let property. Include the flat, floor, building, street, and district.

"差餉估價編號為" / "with Rating Assessment No." Enter the ten-digit Rating and Valuation Department assessment number for the property. You can find this on your rates bill or the property's demand note.

"這物業已於租出" / "This property was let out on" Enter the start date of the tenancy in the format DD/MM/YYYY. A common mistake is using the date the agreement was signed instead of the actual commencement date.

"每月租金為" / "at a monthly rent of" State the monthly rent in Hong Kong dollars. If the tenancy includes a rent-free period or other concessions, enter the actual contracted monthly rent for the period the property is let.

3. Postal Address for Tax Return

"如我須要填交報税表,請寄往以下的通訊地址" / "If a tax return is required, please send it to the following postal address" Only complete this section if you want your future tax return mailed to an address different from your last known address with the IRD. If your address is unchanged, you can leave this blank.

4. Certification

"簽署" / "Signature" The signature must match the one you use on your tax return or previous correspondence with the Inland Revenue Department. If you file jointly, each owner should sign.

"日間聯絡電話號碼" / "Day-time contact telephone no." Provide a phone number where the IRD can reach you during business hours.

"日期" / "Date" Enter the date you sign the form.

Important Notes

  • The form must be sent to the address at the top: Inland Revenue Department, Inland Revenue Centre, 5 Concorde Road, Kai Tak, Kowloon, Hong Kong.
  • The form extract does not mention a deadline. Generally, you should notify the IRD within a reasonable time after the tenancy begins, but the IRD does not prescribe a specific period on this version.
  • Do not invent a fee; none is shown.
