Ad valorem stamp duty is the variable portion of stamp duty, calculated as a percentage of the transaction's value or consideration rather than a fixed fee. The Stamp Duty Ordinance (Cap. 117) imposes this duty on both share transfers and property transactions in Hong Kong. It is charged on the higher of the consideration paid or the market value of the asset transferred. Both buyer and seller pay their share, and the instrument of transfer must be stamped before the transaction becomes legally effective. The Stamp Duty Office handles collection and assessment.
