Hong Kong's double taxation agreements explained

A double taxation agreement Hong Kong has with another jurisdiction is a bilateral treaty preventing the same income from being taxed twice. These agreements, also known as tax treaties, allocate taxing rights between Hong Kong and the partner jurisdiction, providing relief through tax credits or exemptions. The Inland Revenue Department administers these agreements under the Inland Revenue Ordinance (Cap. 112). A Hong Kong tax resident can claim DTA benefits to reduce or eliminate withholding tax on dividends, interest, royalties and capital gains arising in the other jurisdiction.
Hong Kong Tax Treaty List
The Inland Revenue Department maintains a current list of all jurisdictions with which Hong Kong has signed a comprehensive double taxation agreement. This list includes major trading partners across Asia, Europe, the Middle East and Africa. Each agreement is comprehensive, covering all types of income, not a limited arrangement. The Department publishes the full text of each treaty, together with the date it entered into force and the date of effect for Hong Kong tax purposes.
DTA Hong Kong Benefits
For a Hong Kong business, the principal benefit of a DTA is the reduction of withholding tax rates on cross-border payments. Without a treaty, a foreign jurisdiction may impose withholding tax at its domestic rate on dividends, interest and royalties paid to a Hong Kong resident. Under a DTA, that rate is capped at a lower figure. The agreement also clarifies when a person has a permanent establishment in the other jurisdiction, which determines whether business profits are taxable there. The mutual agreement procedure allows taxpayers to resolve disputes where both jurisdictions claim taxing rights.
Avoidance of Double Taxation Hong Kong
Hong Kong provides relief from double taxation through two mechanisms. Under a comprehensive agreement, foreign tax paid on income also taxable in Hong Kong is credited against the Hong Kong tax liability on that same income. Where no treaty applies, Hong Kong grants unilateral relief by way of a tax credit for foreign tax paid on income sourced in a jurisdiction that has a comprehensive agreement. The taxpayer must demonstrate that the foreign tax was paid and that the income is assessable in Hong Kong.
Exchange of Information
Each comprehensive double taxation agreement includes an exchange of information article. This allows the Inland Revenue Department to request information from the tax authority of the partner jurisdiction for tax administration purposes, and to respond to similar requests. The exchange is limited to information that is foreseeably relevant to the administration of tax laws and is subject to confidentiality provisions.
