Relationship to Other Forms

SIS-3 is one of four supplementary information forms used by the Licensing Authority. Form 6 is for individuals and partnerships applying for a new licence or renewal. Form 7 is the main renewal application for companies. SIS-3 is the supplementary form companies must attach to Form 7. SIS-4 is the equivalent supplementary form for individuals and partnerships. The Licensing Authority will not accept a Form 7 without its corresponding SIS-3. The two documents are processed together, and the renewal fee covers both.

Supporting Documents and Verification

The Licensing Authority may require original documents or certified copies with the SIS-3 submission. These can include the business registration certificate, certificate of incorporation, the company's annual return filed with the Companies Registry, and the register of directors and shareholders. The authority may also request the company's most recent audited or management accounts. This verifies the company is still trading and the individuals named in SIS-3 match those in the company's statutory registers. Any discrepancy between the SIS-3 and Companies Registry records will delay the renewal.

Consequences of Incomplete or Incorrect SIS-3

An incomplete, incorrect or incomplete SIS-3 will be returned by the Licensing Authority for correction. The renewal will not be processed until the correct information is provided. If the licence expires during this correction period, the company must stop lending until the new licence is granted. Operating without a valid money lenders licence is an offence under the Money Lenders Ordinance and can result in a fine and imprisonment. The Licensing Authority can also refuse a renewal if it considers the company or any key individual is no longer fit and proper. A refusal to renew must be communicated in writing, and the applicant has a right of appeal to the Administrative Appeals Board.
