  3. Sign the form: A director, company secretary, or authorised tax representative must sign. The signature confirms the information is true and correct.
  4. Attach to BIR51: Include the completed BIRS1 with the Profits Tax Return. Paper filers should staple it to the return. Electronic filers follow portal instructions to attach the form.
  5. Submit by the due date: Ensure the return and BIRS1 are submitted on or before the filing deadline. Late filing may result in penalties and interest.

A tax representative can submit the election on behalf of a corporation through the Tax Representative Portal, provided they have authorisation.

Part 1 - Particulars of the Person

Box 1 - Name of Person Enter the full legal name of the person (individual, partnership, or corporation) making the election. For an individual, use the name as shown on the Hong Kong Identity Card. For a corporation, use the name exactly as it appears on the Certificate of Incorporation.

Box 2 - Business Registration Number Enter the 8-digit Business Registration number. This is found on the Business Registration Certificate issued by the Inland Revenue Department. Do not include the “BR” prefix or any letters.

Box 3 - Address Provide the principal place of business or registered office address. If the person is an individual, use the residential address as recorded with the Inland Revenue Department. Ensure this matches the address on any previous tax returns.

Box 4 - Date of Commencement of Business Enter the date the business started trading. This must be the same date as shown on the Business Registration Certificate. Format as DD/MM/YYYY.

Box 5 - Year of Assessment Write the year of assessment for which the election is made, for example “2023/24”. This is the tax year that begins on 1 April and ends on 31 March of the following year.

Box 6 - Basis Period Enter the accounting period that forms the basis for the year of assessment. For a standard 12-month period ending on 31 March, write “1/4/2023 to 31/3/2024”. If the basis period is different (e.g., a calendar year), state the exact start and end dates.

Part 2 - Election for Two-Tiered Profits Tax Rates

Box 7 - I/We elect that the two-tiered profits tax rates shall apply This is a declaration box. Tick or mark “Yes” to confirm the election. The two-tiered rates apply only to the first HK$2 million of assessable profits (the lower rate) and the remainder at the standard rate. This election is irrevocable for the year of assessment stated in Box 5.

Box 8 - Signature The person making the election must sign here. For a sole proprietor, sign personally. For a partnership, all partners must sign unless the partnership has a designated representative. For a corporation, the signature must be by a director, the company secretary, or an authorised person. Do not use a rubber stamp.

Box 9 - Date Enter the date of signing. This must be on or before the due date for filing the tax return for the year of assessment. If the election is made after the return is filed, the date must still be within the statutory time limit (usually one month after the return due date).

Box 10 - Name of Signatory (in BLOCK letters) Print the full name of the person signing in Box 8. For a corporation, also state the capacity (e.g., “Director” or “Company Secretary”).

Box 11 - Telephone Number Provide a daytime contact number for the signatory or the person responsible for the election.

Box 12 - Date of Receipt (For official use only) Leave blank. This is completed by the Inland Revenue Department upon receipt.

Important Notes

  • Continuation sheets: If more than one person is making the election (e.g., in a partnership), attach a separate sheet listing each partner’s name, Business Registration number, and signature. Number the sheets and reference them in Box 1.
  • Common mistake: The date in Box 4 must match the Business Registration Certificate exactly. If the business started on a different date, the election may be invalid.
  • Who must sign: For a corporation, the signatory must be a director or company secretary. A tax representative cannot sign unless authorised in writing.
