Form IRBR168 is the statutory form for entities to claim exemption from the business registration fee and levy under the Business Registration Ordinance (Cap. 310). It allows public bodies, diplomatic missions, consular posts and international organisations to declare their exempt status and avoid the annual charges other businesses must pay. A successful claim results in a certificate of business registration issued with no fee or levy. The administers this form, which is distinct from Form IRBR61 for general fee exemption claims. Eligible Entities for Exemption

Only specific organisations may use Form IRBR168. The Business Registration Ordinance (Cap. 310) limits eligibility to the following:

  1. Complete the form - enter the entity's legal name, business address, the nature of the exempt business activity and the basis for the claim.
  2. Attach supporting documents - proof of the entity's status is required. A certified copy of the establishing instrument, such as an ordinance, treaty or international agreement, is commonly needed.
  3. Sign the declaration - an authorised officer must sign and date the form.
  4. Submit the form - send the completed form and supporting documents by post or in person. The form is not available for online submission through the Business Tax Portal.

Exemption from Payment Business Registration Levy

The levy funds specific government initiatives. A Form IRBR168 claim covers both the fee and the levy; there is no separate form for the levy alone.

Hong Kong Business Registration Fee Waiver

Part 1 - Business Particulars

1. Name of Business
Enter the full business name exactly as it appears on the existing Business Registration Certificate (for an existing business) or as declared on the business registration application (for a new business).

2. Business Registration Number
Copy the 8-digit number from the Business Registration Certificate. It is usually shown as “BRxxxxxxxx”.

3. Nature of Business
Describe the main activity, e.g. “retail clothing”, “IT consultancy”. This must match the description already registered with the Business Registration Office.

4. Address of Business
Give the principal place of business. If this address has changed since the last registration, the form also serves as a notification of change (see Note 14).

5. Date of Commencement of Business
For a new business, enter the actual start date. For an existing business, enter the date the business first started (not the date of the current certificate). This date must be consistent with the date on the business registration application.

Part 2 - Declaration of Average Monthly Turnover

6. Average total sales/receipts for the period
- Existing business: Calculate the average monthly turnover for the 6 months immediately before the date you sign this form. Use actual gross income (before deducting any costs).
- New business: Use the estimated total turnover for the first 6 months of trading, divided by 6.

7. Total sales/receipts for the period
Enter the total (not the average) for the same 6-month period used in box 6. For an existing business this is the actual total; for a new business it is the estimated total.

8. Period covered
State the start and end dates of the 6-month period used. For an existing business this must end no earlier than the date of application. For a new business it must begin on the commencement date.

Part 3 - Declaration and Signature

9. Name of Business Operator
Print the full name of the sole proprietor or, for a partnership, one of the partners.

10. Signature
The person named in box 9 must sign. For a partnership, any one partner may sign on behalf of all partners.

11. Date
Enter the date of signing. This date determines the 6-month period for the turnover calculation (existing business) and the deadline for submission.

Common Mistakes

  • Mutually exclusive turnover thresholds: If the business mainly derives profits from selling services, the average monthly turnover must not exceed $10,000. For all other businesses the limit is $30,000. Do not mix the two.
  • Multiple businesses: A sole proprietor cannot hold another sole proprietorship at the same time. A partnership cannot have the same partners running another partnership together. Check the examples in the Supplementary Notes carefully.
  • Deadline confusion: For an existing business, the form must reach the Business Registration Office no later than 1 month before the certificate expires (or 1 week before if applying via GovHK). For a new business, it must arrive within 1 month of the business registration application (or 7 weeks if via GovHK).
  • Continuation sheets: If the business has more than one address or multiple partners, attach a separate sheet listing the additional details. Mark it “Continuation Sheet for IRBR168”.
